Robin Junger (McMillan LLP) is lead counsel in PHARA’s constitutional challenge to DRIPA. As Junger puts it in his conversation with Stuart McNish:
“…it’s all the more important now that the constitutional challenge to DRIPA is heard in a timely way. The court may agree or disagree—but if DRIPA is found unconstitutional, it’s a clean reset. You go back to 2019, there is no DRIPA, and the focus returns to meaningfully implementing and respecting Section 35 rights.”
